1. Acceptance of Terms

By accessing or using the services offered by Blue Link Advertising, LLC ("Company", "we", "us", or "our"), you confirm that you are at least 18 years of age and legally capable of entering into binding contracts. These Terms apply to all visitors, users, clients, and others who access or use our services.

2. Services Provided

Blue Link Advertising, LLC provides specialized digital marketing, search engine optimization (SEO), website design, pay-per-click (PPC) management, and digital strategy services. Specific scope, deliverables, timelines, and fees for custom client engagements will be outlined in separate Statements of Work (SOW) or Client Agreements signed by both parties.

3. Intellectual Property Rights

Unless explicitly stated otherwise in a executed agreement:

  • Our Content: All proprietary code, graphic designs, marketing materials, and website assets created by Blue Link Advertising, LLC remain our intellectual property until all outstanding invoices are fully paid.
  • Client Materials: Clients retain full ownership of all trademarks, logos, copy, images, and data provided to us for use in marketing campaigns or website development.

4. Payments & Billing

Invoices are due upon receipt or according to the payment schedule outlined in your specific Service Agreement. Retainers and recurring marketing services are billed in advance on a monthly basis.

Failure to pay invoices within 15 business days of the due date may result in a temporary suspension of services, including pausing active ad campaigns or withholding web deployment assets until account balance is brought current.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Blue Link Advertising, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or third-party algorithm updates (such as Google search ranking adjustments) beyond our direct control.

6. Termination

We may terminate or suspend access to our services immediately, without prior notice or liability, if you breach any of these Terms. Clients seeking to terminate ongoing monthly retainers must provide written notice according to the cancellation timeline established in their specific Service Agreement (typically 30 days written notice).

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Chisago County or the State of Minnesota.
